Booking Terms & Conditions

1. Introduction & Our Role
Travel & Adventures Ltd ("we", "us", "our", or "the Company") is a limited company registered in England and Wales (Company No. 17149161), with a registered address at 7A Sedbergh Road, Kendal, Cumbria, LA9 6AD. We are a member of the Travel Trust Association (TTA) and a travel agent acting on your behalf to arrange travel and holiday packages with licensed tour operators and travel principals, including but not limited to TUI, Jet2 Holidays, easyJet Holidays, and other ATOL-bonded suppliers ("Principals").
By making a booking through Travel & Adventures Ltd, you confirm that you have read, understood, and accepted these Terms & Conditions in full. These Terms, along with the terms and conditions of the relevant Principal(s), form the basis of your contract. All bookings are made subject to the terms of the relevant Principal, copies of which are available on request or directly from the Principal's website.
As agents, we act only as intermediaries. Our liability is therefore limited as set out in these Terms. The contract for your holiday or travel services will be with the Principal, and we are not responsible for any act, omission, or default on the part of any Principal or their employees. The principal’s(s’) or supplier’s (s’) Terms & Conditions will apply to your booking and we advise you to read these carefully as they do contain important information about your booking. Please ask us for copies of these if you do not have them.
Our Terms of Business are governed by English Law and the jurisdiction of the English Courts. Where Westoe Travel act as agent for the Principal or Tour Operator, travel arrangements which we provide or which are sold through us are not an offer by us to sell any travel arrangements, but an invitation to you to make an offer to the suppliers of the arrangements. We are free to accept that offer on behalf of those suppliers or to reject it.
2. Financial Protection (TTA & ATOL)
Travel & Adventures Ltd is a member of the Travel Trust Association (TTA), the only travel network in the UK to guarantee 100% financial protection to the consumer, ensuring total consumer confidence. All client monies paid to us are held in a protected TTA trust account and are never used for any purpose other than funding your travel arrangements. This protection applies to all bookings we make, whether or not they include flights.
In addition, all flight-inclusive holidays and flights we arrange are booked through Principals who hold their own ATOL licence issued by the Civil Aviation Authority (CAA). Where your booking is ATOL protected by the Principal, you will receive an ATOL Certificate directly from that Principal confirming the protection in place. ATOL protection applies to customers who book and pay in the United Kingdom for flight-inclusive packages. For further information on ATOL, visit: www.atol.org.uk
Together, your TTA protection and the Principal’s ATOL cover mean that your money is safe from the moment you pay. We will always confirm the financial protections applicable to your specific booking at the time of confirmation, and provide the relevant ATOL number and TTA details in writing. It is important that you retain all documentation as proof of your protection.
3. Making a Booking
To make a booking, you must be 18 years of age or over. By booking on behalf of your party, you confirm you have the authority to do so and that all members of your party agree to be bound by these Terms & Conditions.
A booking is confirmed and a contract formed only when we have received your deposit (or full payment where applicable) and issued written confirmation. Receipt of a booking enquiry or deposit alone does not constitute a confirmed booking.
The lead name on the booking is responsible for ensuring all information provided — including passenger names, dates of birth, and passport details — is correct. We cannot accept liability for any loss arising from incorrect information supplied to us.
Please check that all names, dates and timings are correct on receipt of all documents and advise us of any errors immediately. Any changes to these details will incur the charges stated below. Please ensure that the names given are the same as in the relevant passport. The booking information that you provide to us will be passed on only to the relevant suppliers of your travel arrangements or other persons necessary for the provision of your travel arrangements. The information may therefore be provided to public authorities such as customs or immigration if required by them, or as required by law. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary and religious requirements.
Certain information may also be passed on to security or credit checking companies. If you are travelling to the United States, the US Customs and Border Protection will receive this information for the purposes of preventing and combating terrorism and other transnational serious crimes. If you travel outside the European Economic Area, controls on data protection may not be as strong as the legal requirements in this country. If we cannot pass this information to the relevant suppliers, whether in the EEA or not, we will be unable to provide your booking. In making this booking, you consent to this information being passed on to the relevant persons. Full details of our data protection policy are available upon request.
4. Payments & Pricing
Deposits
A non-refundable deposit is required at the time of booking to secure your holiday. The deposit amount will be confirmed at the time of booking and will vary depending on the Principal and type of holiday booked. The deposit will be retained in the event of cancellation.
Balance Payments
The balance of your holiday cost must be paid no later than the date specified on your booking confirmation — typically 14 weeks before departure, depending on the Principal's requirements. If full payment is not received by the balance due date, we will notify the principal(s) or supplier(s) who may cancel your booking and charge the cancellation fees set out in their Terms and Conditions and/or section 6 .
Methods of Payment
Payment can be made by bank transfer or card. Please note:
• Commercial credit cards may incur a processing surcharge — this will be confirmed before payment is taken.
• Cheques require 7 working days to clear and must be received prior to payment deadlines.
• All prices are quoted in pounds sterling (GBP) and are subject to availability.
Price Changes
Prices quoted are subject to change prior to booking confirmation. Once confirmed, we will endeavour to protect your price; however, Principals reserve the right to apply surcharges in exceptional circumstances (e.g. significant fuel cost increases, government-imposed taxes, or adverse exchange rate movements). Where a surcharge exceeds 10% of your holiday price, you will have the right to cancel and receive a full refund of monies paid.
5. Alterations Requested by You
All requests to amend a confirmed booking must be made in writing. We will endeavour to accommodate your request, but amendments are subject to availability and the conditions of the relevant Principal. Amendment fees may apply, and costs will vary depending on how close to departure the change is requested.
Where amendment is not possible, you may need to cancel and rebook, in which case the cancellation charges in the principal(s) or supplier(s) Terms and Conditions (which may be 100% of the cost of the travel arrangements) and/or Section 6 will apply.
6. Cancellation by You
You, or any member of your party, may cancel a confirmed booking at any time. All cancellations must be notified to us in writing. Cancellation takes effect from the date we receive your written notification.
Cancellation charges will apply as a percentage of the total booking price. The charges will reflect those imposed by the relevant Principal and may vary by supplier. As a general guide, the following charges are typical — however, you will be advised of the specific cancellation policy applicable to your booking at the time of confirmation:
• More than 98 days before departure: Loss of deposit only
• 57–98 days before departure: 40% of total holiday cost (or deposit if greater)
• 29–56 days before departure: 50% of total holiday cost
• 15–28 days before departure: 75% of total holiday cost
• 8–14 days before departure: 90% of total holiday cost
• 7 days or fewer before departure: 100% of total holiday cost
Note: Budget, low-cost, and charter flight bookings, as well as cruises and certain specialist products, may attract different cancellation terms. These will be made clear at the time of booking.
If your reason for cancellation is covered under the terms of a valid travel insurance policy, you may be able to recover applicable charges from your insurer. We strongly recommend that travel insurance is taken out at the time of booking.
7. Alterations or Cancellations by the Principal
Occasionally, Principals may need to make changes to your holiday. Most changes are minor (e.g. a flight time adjustment), but in some cases significant changes may be necessary. Where the Principal notifies us of a significant change or cancellation, we will contact you as soon as possible.
In the event of a significant change or cancellation by the Principal, you will generally be entitled to:
• Accept the changed arrangements
• Accept an alternative holiday of comparable or superior standard (if available)
• Cancel and receive a full refund of all monies paid
Your rights in these circumstances are governed by the Package Travel and Linked Travel Arrangements Regulations 2018, and by the terms of the Principal. We will assist you in exercising those rights but bear no additional liability beyond our role as agent.
8. Events Beyond Our Control (Force Majeure)
Neither Travel & Adventures Ltd nor the relevant Principal will be liable or responsible for any failure to perform, or delay in performance of, any obligation where such failure or delay is caused by events beyond reasonable control. Such events include, but are not limited to: acts of God, war, terrorism, civil unrest, epidemic or pandemic, natural disaster, fire, extreme weather conditions, airport or airspace closures, government action or restriction, industrial action, or FCDO advice against travel to a destination.
In such circumstances, your rights will be governed by the terms of the relevant Principal and applicable UK law, including the Package Travel and Linked Travel Arrangements Regulations 2018.
9. Travel Insurance
Adequate travel insurance is a booking condition and we strongly recommend that cover is arranged at the time of booking. Your policy must, as a minimum, cover:
• Trip cancellation and curtailment
• Medical expenses and emergency repatriation
• Personal liability
• Loss of baggage and personal effects
• All activities and excursions you intend to undertake
If you choose to travel without adequate insurance cover, Travel & Adventures Ltd will not be liable for any losses you suffer that would otherwise have been covered by insurance. We can assist with recommending insurance providers on request.
10. Passports, Visas & Health Requirements
It is your responsibility to ensure that all members of your party hold valid travel documents required for your destination. Requirements vary by nationality, destination, and type of travel, and are subject to change. We recommend you check the following official sources well in advance of travel:

If you or any member of your party is refused entry at the border due to insufficient documentation, all repatriation costs will be borne by the passenger. We cannot accept liability for any loss arising from failure to comply with travel document or health requirements.
11. Special Requirements & Assistance
If any member of your party has a disability, medical condition, dietary requirement, or any other special need, please advise us at the time of booking. We will pass this information to the relevant Principals and suppliers and do our best to accommodate your requirements, subject to availability.
All information provided will be treated in confidence and used only for the purposes of your booking. We cannot guarantee that all special requests can be met, and fulfilment of a special request does not form part of our contractual obligation unless confirmed in writing.
12. Liability
As travel agents, we act as intermediaries between you and the Principal(s) or suppliers (s). Our liability to you is therefore limited as follows:
• We are not liable for any act, omission, or default on the part of any Principal or third party supplier.
• Where we are found to be directly liable for a failure to perform our own obligations, our liability shall not exceed the total amount paid by you to us for the relevant booking, less any expenses incurred.
• We do not accept liability for death, personal injury, loss, or damage arising from the acts or omissions of third parties beyond our reasonable control.
Nothing in these Terms seeks to exclude or limit liability for personal injury or death caused by our own negligence, or liability that cannot be excluded by law.
For air travel, sea travel, rail travel, and accommodation, liability is further limited by the relevant international conventions, which are incorporated into these Terms by reference.
13. Complaints
We pride ourselves on the quality of our service and take all complaints seriously. If you experience a problem during your holiday, you should report it to the relevant supplier or Principal at the time so that it can be resolved as quickly as possible.
If you remain dissatisfied on your return, please contact us in writing within 28 days of your return date. We will investigate and respond as promptly as possible. Complaints relating to illness or injury must be submitted within 2 weeks of the end of the holiday.

14. Data Protection & Privacy
Travel & Adventures Ltd is committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. We collect and process your personal data in order to arrange and manage your travel booking.
Your data may be passed to Principals, airlines, hotels, transfer companies, and other suppliers as required to fulfil your booking. Some suppliers may be based outside the UK/EEA, and in such cases, we will try to ensure appropriate safeguards are in place.
We will not sell or share your personal data for marketing purposes without your consent. For full details of how we collect, use, and protect your data, please refer to our Privacy Policy available on request.
15. Package Travel Regulations
Where your booking constitutes a package under the Package Travel and Linked Travel Arrangements Regulations 2018, you will benefit from the full protections afforded by that legislation. We will make clear at the time of booking whether your arrangements constitute a package.
16. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Acceptance of Terms
By proceeding with a booking and paying your deposit, you confirm that you have read, understood, and agreed to these Terms & Conditions as well as those of the supplier(s) and or Principle(s) on behalf of yourself and all members of your travelling party.
